The sponsor, typically a company or educational institution, supports the visa application by affirming the individual’s purpose for entering the country, ensuring their financial support, and often taking on other legal obligations during their stay.

While sponsorship is perhaps most well-known for work visas, it is also common for investor and some tourist visas. 

What are the responsibilities of a sponsoring employer?

Sponsoring an employee involves several key responsibilities:

  • Documentation and application: The employer must provide essential documentation to support the visa application. This includes proof of business legitimacy, justification for hiring a foreign national, and assurance of sufficient funds to pay the employee.
  • Compliance with labor laws: A sponsor must ensure that employment terms comply with local labor laws, including adherence to minimum wage and working condition standards.

    In the U.S., the Immigration Reform and Control Act (IRCA) of 1986 requires employers to verify the legal employment eligibility of all workers, including non-citizens. This means ensuring that the sponsored employee has the proper authorization to work in the country.
  • Financial responsibilities: Employers must also demonstrate the ability to financially support the employee during their stay, which may include salary, benefits, and sometimes relocation costs.
  • Notification of changes: Sponsors are required to inform immigration authorities about significant changes in employment status, such as job termination or major changes to the employment contract.
  • Support for the employee: This includes providing assistance to the sponsored employee in settling into the new country, including help with housing, understanding legal rights, and other onboarding support.

What are the different types of employment visas that require sponsorship?

  • H-1B Visa (US): This visa is aimed at specialty occupations that require specific expertise, particularly in fields like information technology (IT), engineering, and finance. Employers must sponsor the applicant and demonstrate that the role cannot be filled by a local candidate.
  • Tier 2 Visa (UK): This visa category is for skilled workers who have received a job offer from a UK employer who holds a valid sponsorship license. The employer provides a certificate of sponsorship to support the visa application.
  • Temporary Skill Shortage Visa: Subclass 482 (Australia) replaces the 457 visas and allows employers to sponsor foreign skilled workers when no skilled Australian workers are available to fill specific positions.
  • Blue Card (EU): This is an EU-wide permit that allows highly skilled non-EU citizens to work in any EU member state (except Denmark, Ireland, and Norway), requiring sponsorship from an EU employer.
  • Canadian LMIA-based work visas: Canadian employers must obtain a Labor Market Impact Assessment (LMIA) to hire foreign workers, demonstrating that no Canadian citizen or permanent resident is available to perform the job.
