Hiring in Albania means balancing a genuine need to verify who you are employing against a data protection regime that is steadily moving towards European standards. Most checks are permitted, but each one needs a clear purpose and the candidate’s agreement.

What employers can check

There is no single statutory list of mandatory pre-employment checks for general roles in Albania. Employers typically verify identity, previous employment, and academic qualifications. Criminal record checks are common, and become effectively unavoidable in regulated sectors such as banking, insurance, private security, education, healthcare, and any role working with children or vulnerable adults.

The criminal record certificate

The standard document is the Dëshmi Penaliteti, a certificate of criminal status issued through the Ministry of Justice and available via the e-Albania online portal. In practice the candidate requests it themselves and hands the certificate to the employer, rather than the employer approaching the police directly. Turnaround is usually a few working days, and certificates intended for use abroad normally need an apostille.

Consent and data protection

Written consent from the candidate is required before any check begins. Personal data handling is governed by Albania’s data protection legislation, which has been progressively aligned with the GDPR as part of the country’s EU accession process. The practical effect is familiar: collect only what the role genuinely requires, tell the candidate what you are collecting and why, keep it secure, and do not hold it for longer than you need.

Checks that need more care

Credit checks and health screening are only defensible where the role clearly justifies them, for example a finance position or work carrying a physical safety requirement. Questions touching political opinion, trade union membership, religion, or health fall into sensitive data territory and should be avoided unless a specific legal basis applies.

Getting it right
