Australia has one of the more structured background screening environments, with a national police check system, sector specific clearances, and a privacy regime that shapes how results can be handled.

The national police check

The standard criminal record check is the Nationally Coordinated Criminal History Check, obtained through the Australian Criminal Intelligence Commission or one of its accredited providers, or through state police. Candidates usually apply themselves using the employer’s consent form. Results are often returned within a few days, though anything requiring manual review by a police agency takes longer.

Sector specific clearances

Roles involving children require a Working with Children Check, administered at state and territory level and entirely separate from a police check. Aged care, disability services, and healthcare roles carry their own clearance requirements. Some financial services and government positions need additional vetting or a security clearance.

Spent convictions

Each state and territory operates a spent convictions scheme, so older minor convictions drop off a check after a set period and cannot be taken into account. Disclosure rules differ between jurisdictions, which means a national hiring policy needs to work to the strictest of them rather than the most permissive.

Privacy and discrimination

The Privacy Act governs how screening data is collected, used, and stored, and candidates must consent and be told the purpose. Refusing to hire on the basis of an irrelevant criminal record can support a discrimination complaint, so any conviction relied on needs to relate to the inherent requirements of the role. Credit checks and health information both need specific justification.

Practical guidance

Write down which checks apply to which roles and why, obtain written consent, and give candidates a chance to explain anything that comes back. Store results securely and destroy them once they are no longer needed. An employer of record can manage screening and compliant onboarding if you have no Australian entity.
