Canada permits employment background checks, but human rights legislation and a patchwork of federal and provincial privacy laws place real limits on what an employer can ask for and how a result can be used.
Criminal record checks
The standard options are a name based criminal record check through local police or an accredited provider, and a fingerprint based certified check through the RCMP where identity needs to be confirmed. A separate vulnerable sector check applies to roles working with children or vulnerable adults and can only be requested where the position qualifies. Candidates normally apply themselves and share the result.
Human rights limits
Several provinces treat a record of offences, or a conviction that has received a record suspension, as a protected ground. Refusing to hire on that basis can support a human rights complaint unless the offence is genuinely relevant to the duties of the role. The safe approach is to assess relevance rather than apply a blanket rule, and to give the candidate a chance to respond.
Credit and other checks
Credit checks are only defensible for roles with genuine financial responsibility, and consumer reporting legislation in most provinces requires notice and consent. Employment and education verification are uncontroversial and widely used. Social media screening carries discrimination risk because it exposes protected characteristics that are not relevant to the role.
Privacy
Federal legislation applies to federally regulated employers and to commercial activity, while British Columbia, Alberta, and Quebec have their own private sector statutes. Quebec’s regime is the most demanding, with detailed consent and transparency obligations. Across all of them the principles are consistent: collect only what is necessary, obtain informed consent, explain the purpose, and retain no longer than needed.
Practical guidance
Set out in writing which checks apply to which roles and why, obtain written consent, and store results securely with restricted access. An employer of record can manage screening and compliant onboarding if you have no Canadian entity.
