Colombia has a well developed set of public record checks, but constitutional case law has narrowed what private employers can demand. The distinction between what is technically available and what is lawful to require matters here.
The public certificates
Three certificates are commonly encountered. The judicial records certificate is issued by the National Police, the disciplinary records certificate by the Procuraduria General, and the fiscal responsibility certificate by the Contraloria General. All are free and available online, and candidates can obtain them directly.
Limits on requiring them
The Constitutional Court has held that requiring judicial records as a general condition of private sector employment can amount to discrimination and undermine reintegration. Public sector roles and specific regulated positions are treated differently, and financial services, private security, childcare, and roles handling public funds have clearer justification. Outside those, a blanket requirement is difficult to defend.
What employers can check
Identity through the cedula, employment history, and academic qualifications are all routine. Professional roles often require registration with the relevant council, which is straightforward to confirm. Social security contribution records give a reliable view of formal work history.
Data protection
The habeas data framework governs processing and is supervised by the Superintendency of Industry and Commerce. Prior authorisation from the data subject is required, sensitive data attracts stricter treatment, and individuals have strong rights to correct and remove information. Registering databases and honouring access requests are practical obligations, not formalities.
Checks to avoid
Pregnancy testing and HIV testing as hiring conditions are prohibited. Health screening is limited to the occupational medical examination assessing fitness for the specific role.
Practical guidance
Decide role by role whether a records check is justified and document the reason, obtain written authorisation, and apply the process consistently. An employer of record can manage screening and compliant onboarding if you have no Colombian entity.
