Costa Rica combines an accessible criminal record system with a data protection regime that employers need to take seriously. Checks are permitted, but proportionality and consent are genuine requirements rather than formalities.

Criminal record checks

The document is the hoja de delincuencia, issued by the Registro Judicial within the judiciary. Candidates apply themselves, in person or through the judicial branch’s online service, and provide the certificate to the employer. It shows convictions that remain current rather than a complete lifetime history, and it is only accepted as valid for a limited period. Screening is expected in financial services, private security, education, childcare, healthcare, and roles handling cash or valuables.

What employers can check

Identity, employment history, and academic qualifications are all routine. Social security records give a dependable view of formal employment. Professional roles frequently require membership of the relevant colegio profesional, which is easy to verify and is a genuine condition of practice rather than a preference.

Data protection

Costa Rica’s data protection law is supervised by the national agency for the protection of personal data, and it requires informed consent, purpose limitation, and security measures. Sensitive data attracts additional protection, and individuals have rights of access and correction. Employers holding personal databases have registration obligations worth checking before building a screening process.

Checks to avoid

Pregnancy testing and HIV testing as conditions of employment are prohibited. Health screening should be confined to fitness for the particular role and carried out through occupational health channels.

Practical guidance
