Ecuador permits employment background checks within a labour law framework that is strongly protective of workers and a data protection regime introduced in recent years. Proportionality is the practical test.

Criminal record checks

The document is the certificado de antecedentes penales, issued through the Ministry of the Interior and the National Police and available as an online service. Candidates obtain it themselves and provide it to the employer. Screening is expected in financial services, private security, education, childcare, healthcare, transport, and roles handling cash or valuables. Requiring it universally across unrelated roles is harder to justify.

What employers can check

Identity through the cedula, employment history, and academic qualifications are all routine. Social security records give a reliable view of formal employment. Professional roles usually require registration of the qualification with the higher education authority, which is verifiable online and is a genuine condition of practice.

Data protection

Ecuador’s organic law on personal data protection introduced consent, purpose limitation, transparency, and security obligations modelled on European lines, with a supervisory authority and meaningful penalties. Criminal record and health data are sensitive categories requiring a stronger basis. Collect only what the role needs, explain the purpose, secure the data, and delete unsuccessful applicants’ information once recruitment ends.

Checks to avoid

Pregnancy testing and HIV testing as conditions of employment are prohibited, and dismissal or refusal to hire on those grounds carries serious consequences. Health screening is confined to the occupational examination assessing fitness for the specific role.

Practical guidance

Document why each check applies to each role, obtain written consent, and apply the process consistently across candidates. An employer of record can manage screening and compliant onboarding if you have no Ecuadorian entity.
