Background Checks for Employment in Equatorial Guinea

Equatorial Guinea has a small formal labour market dominated by oil and gas, government, and the companies that service them. Screening is possible but relies on manual, ministry based processes, so timelines are the main planning constraint.

What employers can check

Identity, employment history, and academic qualifications are the standard verifications. Confirming diplomas with the issuing institution matters, and qualifications obtained abroad generally need formal recognition before they can be relied on for regulated roles. References carry real weight in a market where the significant employers know one another.

Criminal record checks

The document is the certificado de antecedentes penales, issued through the Ministry of Justice and requested by the individual rather than the employer. Processing is manual and can take some weeks, particularly for candidates from outside Malabo and Bata. The certificate is treated as current only for a limited period. Screening is expected in banking, the oil and gas sector, private security, education, healthcare, and roles involving cash or sensitive information.

Consent and privacy

There is no comprehensive data protection statute of the European kind in force, so employer practice sets the standard. Take written consent before screening, explain to the candidate what is being collected and why, keep the enquiry proportionate to the role, store results securely with restricted access, and dispose of them once they are no longer needed. International employers should apply their home standard by default.

Foreign workers and medical checks

Non-nationals need a work permit and residence authorisation, and local content rules give preference to nationals for many positions. Pre-employment medical examinations are standard in the energy and industrial sectors.

Practical guidance

Start screening early and apply the same checks consistently across candidates for a role. An employer of record can manage screening, permits, and payroll if you have no local entity.
