Guatemala uses two separate background certificates rather than one, and employers new to the country frequently ask for the wrong one or assume a single document covers both.

The two certificates

The antecedentes penales certificate is issued by the judiciary and confirms the absence of criminal convictions. The antecedentes policiacos certificate is issued by the National Civil Police and covers police records. Both are obtained by the candidate, both are commonly requested together, and each is treated as current only for a limited period. Employers should specify which they need rather than leaving it to the candidate to guess.

What employers can check

Identity through the DPI, employment history, and academic qualifications are all routine. Social security records give a reliable view of formal employment. Professional roles often require registration with the relevant colegio profesional, which is a genuine condition of practice and straightforward to verify.

Consent and privacy

Guatemala does not have a comprehensive data protection statute of the European type in force, so employer practice sets the standard. Take written consent before screening, explain to the candidate what is being collected and why, keep the enquiry proportionate to the role, store results securely with restricted access, and dispose of them once recruitment closes.

Checks to avoid

Pregnancy testing and HIV testing as hiring conditions are prohibited, and using either as a filter carries real exposure. Health screening should be confined to fitness for the specific role and arranged through occupational health channels rather than general medical enquiry.

Practical guidance

Tell candidates clearly which certificates you need and allow time for both. Apply the same requirements to everyone considered for a role, and keep evidence of consent. An employer of record can manage screening and compliant onboarding if you have no Guatemalan entity.
