Hong Kong is more restrictive than its reputation suggests. The standard criminal record certificate is not available for ordinary employment purposes at all, which surprises employers arriving from other markets.
The certificate of no criminal conviction
The Hong Kong Police issue a Certificate of No Criminal Conviction only for specific purposes, principally visa, residence, and certain licensing applications. It is not issued so that a candidate can hand it to a prospective employer, and applications are made through the requesting authority rather than at the candidate’s initiative. An employer therefore cannot rely on it as a general screening tool.
The sexual conviction record check
For roles involving children or mentally incapacitated persons, a dedicated scheme allows an employer to ask a prospective employee to check their own record and disclose the result. Participation is voluntary in form, and the scheme discloses only sexual offence convictions. This is the appropriate route for schools, childcare, and similar settings.
Rehabilitation of offenders
A person with a single minor conviction who has stayed out of trouble for a set period is generally entitled to treat that conviction as spent, and questions must not be framed to draw it out. Blanket questions about any conviction ever are unsafe.
Data protection
The Personal Data (Privacy) Ordinance applies, and the Privacy Commissioner’s code of practice on human resource management sets clear expectations. Collect only what is necessary for the role, tell candidates the purpose, and destroy unsuccessful applicants’ data within a defined period.
Practical guidance
Design around employment and qualification verification rather than criminal record checks. An employer of record can manage this if you have no Hong Kong entity.
