  • Overtime: Workers can agree to work overtime or may be compelled to do so by their employers in urgent situations. They cannot work more than 15 total hours a day, including overtime, and cannot work more than 60 overtime hours per month without an official exception. Workers must be paid 150% of their normal wages for overtime hours.
  • Annual Leave: Employees are entitled to 24 calendar days (counting weekends and public holidays) of fully paid annual leave, accumulated at the rate of two days per month of service. Leave can be accumulated and used in later years, or converted into wages if the employee wishes.
  • Maternity and paternity leave: Pregnant employees are entitled to 16 weeks of paid maternity leave, and may also take an additional 12 weeks of unpaid leave. The employer must pay the employee her full wages for her maternity leave, but can then be reimbursed by the Agency for Social Protection. New fathers can take up to ten days of paternity leave, which is paid for by the employer.

Payroll Management

Tax Compliance

In the Seychelles, as in most other countries, employers are required to calculate, withhold, and remit PAYE taxes on their employees’ income. Fixed-term contracts are allowed for a maximum of two years, and these can be renewed to a total of six years. Probationary periods are allowed and are limited to six months’ duration.

Onboarding

Once your employees have been contracted, you can start onboarding them. To get them started with your organization, you may need to give them orientations and job-specific training, as well as give them the tools and access to systems and data they need to do their work. The PEO will also need to onboard them to its system. It will add them to your payroll, collect their documents and personal information, set up their salary payments, and register them with the SRC and SPF for their taxes and benefits.

Terminations

If you need to terminate Seychellois workers in the future, your PEO will help advise you on how to proceed with this sensitive process. It’s allowable to dismiss workers for gross misconduct without notice. For other types of dismissals, however, you must give your employees advance notice.

During probation, the minimum notice period is one week. After probation, the minimum notice period for termination is one month. Payment may also be made in lieu of notice. Severance pay is not normally required in the Seychelles, unless it has been included in an employee’s contract.
